HSBC A World of Opera Terms and conditions
Acknowledgement
These Terms and Conditions apply to you so far as the law permits so please read them carefully.
By entering the ballot to attend this Event, you agree to read these Terms and Conditions carefully and fully understand the meanings and implications.
HSBC Bank Australia Limited (ABN 48 006 434 162) of Level 36 One International Towers, 100 Barangaroo Avenue, Sydney NSW 2000 (“HSBC”) is the “Promoter” of this Event and Opera Australia Pty Ltd (ABN 26 000 755 153) (“OA or Opera Australia”) of 480 Elizabeth Street, Surry Hills, New South Wales, 2010 is the “Event Partner” providing the registration and ticketing platform to manage all the elements of the Event for the Promoter.
You should always act in a safe and responsible manner. You take part in any Event at your own risk and are responsible for the safety and supervision of any children in your care. In the interests of safety, please follow any instructions made by officials, including NSW Health for COVID-19 rules by participating in the Event and/or entering the competition (or permitting any children in your care to do so), the entrant (or guardian on the child’s behalf) confirms his/her acceptance of these Terms and Conditions.
Can I enter/take part in the Event?
- Entry to the ticket ballot is for anyone 18 years and over.
- The event is suitable for all ages.
- Entry to win tickets is via a ticket ballot that will be promoted by HSBC and Opera Australia from Friday 23 June to 5pm Monday 3 July 2023 (AEST).
- There is no cost to take part in this Event, however tickets are not automatically guaranteed.
- All participants must enter the ticket ballot to go in the draw to win tickets by registering their details and accepting these Terms and Conditions as part of the entry.
- Entrants must select the number of tickets required, entrants can register for up to a maximum of four (4) tickets per entry.
- It is a condition of entry for all entrants to join Opera Australia’s promotional program, which includes receiving emails from Opera Australia about upcoming events and promotions.
- Access to the Event is only during the hours of the Opera performance 3pm – 4.15pm AEST Sunday 16 July 2023.
Prize
The prize is up to four (4) performance tickets per winner (the number of tickets is dependent upon how many tickets the participant requested at time of entering the ballot.) A performance ticket includes one 75-minute opera performance only. There are 1,500 tickets available valued at AU$100 per ticket.
How will the winner(s) be chosen and notified?
- Winners will be drawn by random selection by Opera Australia on Tuesday 4 July 2023
- Winners will be contacted by email by Opera Australia, within 3 business days of the draw, and will provide a link for winners to confirm attendance
How do winners confirm attendance at the event?
- Winners must use the Opera Australia booking link to confirm their attendance and pre-select their seats prior to attending the event.
- Upon successful completion of the booking, Opera Australia will issue the winner digital ticket(s) via email.
- Winners must bring proof of tickets by either a digital or printed copy to the event, on event day.
The details
- The Event is promoted and hosted by HSBC with Opera Australia as its co-host. The Event will take place in the Joan Sutherland Theatre, Sydney Opera House, Bennelong Point, Sydney, NSW.
- The Event and venue is registered as COVID Safe.
- Maximum capacity of the Event is 1,500.
Special Conditions
- Allocated seating will be available for use, winners must pre-select their seats prior to event day using the link provided by Opera Australia. Once the winner’s seats have been selected Opera Australia will email digital tickets direct to the winner(s).
- Winners must provide proof of ticket confirmation upon entry at the event. All children (under 18) should be supervised by an adult when participating in this Event.
- If the Event offered is unavailable due to circumstances beyond the control of the Promoter or Event Partner, the Promoter or Event Partner may offer an alternative event at their discretion.
- There will be no cash, or part cash equivalent payable to attend this Event. The event is non-transferable, non –resalable, non-negotiable and non-refundable.
- The participants in this Event agree to take part and allow their participation to be used in any promotional materials reasonably issued by the Promoter and/or Event Partner, including but not limited to, photography and filming of the participants.
- The Promoter and/or Event Partner reserves the right, with reasonable cause (including any failure to comply with any of these Terms and Conditions or otherwise), to refuse entry or service to, or expel any person/s from the Event.
- The decision of the Promoter/Event Partner is final and binding and no correspondence will be entered into.
- The participants agree to be contacted (through email address provided to the Event Partner) for the sole purpose of the Promoter and/or Event Partner providing updates about the Event and a post Event survey which will be sent on or about Monday 17 July 2023.
Additional rules
- Participants must not breach or infringe the rights of any sponsors, suppliers, or other parties commercially associated with the Event nor conduct any unauthorised promotions or commercial activities.
- All participants must comply with all the applicable COVID Health and Safety laws/regulations in force together at the HSBC event and Opera Australia venue rules.
Each participant at the Event must not:
- disrupt or interfere with the performances and Event in any way;
- cause unreasonable annoyance to any other spectator(s), official or employee of the Event Partner, or interfere with the comfort of any spectator(s) or their enjoyment of the event;
- use indecent or obscene language or threatening or insulting words or otherwise behave in a threatening, abusive, riotous, indecent or insulting manner; or
- make, create, store, record or transmit any form of visual footage, audio- visual footage, sound recording, information or other data of, at or in relation to the Event other than for personal, private and non-commercial purposes.
COVID-19
You must follow any restrictions or requirements imposed by the Promoter, Event Partner, venue or NSW Government in relation to COVID-19. This includes not attending the Event:
- if you have COVID-19;
- if you feel unwell or have symptoms of COVID-19;
- are awaiting the results of a COVID-19 test; or
- if you are required to be self-isolating for any reason, including if you are a household or high risk contact
By attending the Event, you accept all risks associated with the Event, including risks of exposure to COVID-19. These risks exist at any place where people gather. You confirm that you have considered these risks in light of your own circumstances.
Privacy Information
The Promoter and Event Partner collect personal information ("PI") in order to provide services to individuals and to conduct the Event and may, for this purpose, may disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Without having the required PI, the Promoter/Event Partner may not be able to provide the services or enter the individuals into the Event. The Promoter/Event Partner will use and handle PI as set out in its Privacy Policy, which can be viewed at www.hsbc.com.au and https://opera.org.au/privacy-policy/.
The Privacy Policy also contains information about how individuals may opt out, access, update or correct their PI, how they may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. You consent to your data being stored, transferred and processed by the Promoter, the Event Partner and each of their group companies and contractors and authorise third parties to contact you in order to organise your participation in the Event.
Liability
The Promoter, the Event Partner and each of their group companies and contractors will not be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this Event or as a result of your participation in the Event or as a result of your winning, collecting, use or enjoyment of any prize, or if the Event does not run as planned. This clause does not seek to exclude the liability of the Promoter, the Event Partner and each of their group companies and contractors for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for them to exclude or attempt to exclude their liability.
The Promote, the Event Partner and its contractors can change these terms and conditions or cancel the Event at their discretion and without incurring liability as a result.
NSW Health guidelines change from time to time and can occur less than 24 hours prior to the Event. While Promoter and/or Event Partner will take reasonable efforts to communicate the requirements and/or restrictions to participants, it may not be possible to communicate these terms to participants in time. The Promoter and/or the Event Partner will not be held liable for any losses which the participants may incur as a result of these changes.
In return for attending and/or participating in this promotion you agree and consent to grant the Promoter and Event Partner the absolute and irrevocable right and permission to use (and allow their group members and other third parties to use) your name and likeness (or that of your child(ren) were they also featured) to: reproduce, edit, exhibit, project, display, copyright, publish the moving and/or still pictures and/or videotaped images of you/them with or without your/their voice, or in which you/they may be included in whole or in part, photographed, taped, videotaped and/or recorded and to circulate the same in all forms of the Promoter’s (or its group members’) projects in all or any media (including but not limited to their promotional materials, intranet and internet pages (including third party platforms such as YouTube or other social media)) in connection with the Promoter’s sponsorships. You waive your moral rights and the moral rights of your dependant/ward in any of the works that may arise as referred to in this paragraph.
You confirm that you have the right to enter into these Terms and Conditions, and that are not restricted by any rights or commitments to any third parties. It is acknowledged that you have agreed to waive compensation for such consent and that no other compensation is required. By this consent, you waive any and all claims that may exist in connection the above.
These Terms and Conditions and any disputes arising from these Terms and Conditions are governed by the laws of New South Wales and the exclusive jurisdiction of the New South Wales courts.
